These Terms of Service (“Terms”) govern your use of the website located at foradigital.com (the “Site”), operated by FORA Digital LLC, a limited liability company incorporated in the State of New Jersey, USA (“FORA Digital,” “we,” “us,” or “our”).

By accessing or using our Site, or by submitting a contact or quote request form, you agree to these Terms. If you do not agree, please do not use the Site.

1. Our Services

FORA Digital LLC provides website design, redesign, development, hosting coordination, and maintenance services for businesses. Information on this Site — including descriptions of our services and any general pricing information — is provided for informational purposes only and does not constitute a binding offer.

1A. Company Authority

FORA Digital LLC is a duly organized limited liability company. Any communication you have with Harry Foodim, Corey Rapkin, or any other individual associated with FORA Digital LLC through this Site is on behalf of the company, not in an individual or personal capacity. Nothing on this Site or in these Terms shall be construed to impose personal liability on any member, manager, or owner of FORA Digital LLC.

2. Quotes and Requests

When you submit a request through our contact/quote form, you are asking us to evaluate your project and provide you with information, a proposal, or an estimate. Please note:

• Submitting a form does not create a contract, obligation, or agreement between you and FORA Digital LLC.
• Quotes and estimates provided in response to a form submission are preliminary and subject to change based on further discussion, scope clarification, or a formal written agreement.
• Any actual engagement for services (website redesign, hosting, maintenance, etc.) will be governed by a separate, signed Website Design and Development Services Agreement and its accompanying Statement(s) of Work (“SOW”) between you and FORA Digital LLC, which will take precedence over these Terms for that engagement, including with respect to payment, ownership, warranties, liability, and dispute resolution.

3. Accuracy of Information You Provide

You agree to provide accurate and truthful information when submitting a request (such as details about your company size, project scope, or hosting needs). We rely on this information to prepare estimates and proposals, and are not responsible for inaccuracies in quotes that result from incomplete or incorrect information you provide.

4. Intellectual Property

All content on this Site — including text, graphics, logos, and design — is the property of FORA Digital LLC unless otherwise noted, and may not be copied, reproduced, or used without our prior written permission.

5. Acceptable Use

You agree not to use this Site to:

• Submit false, misleading, or fraudulent information
• Attempt to gain unauthorized access to the Site or any related systems
• Interfere with the proper functioning of the Site
• Use the Site for any unlawful purpose

We reserve the right to disregard any form submission we reasonably believe violates these Terms.

6. No Warranty

This limitation does not apply to obligations undertaken in a separate signed services agreement, which will have its own terms.

8. Third-Party Services

Our Site is hosted using Netlify, and form submissions are processed through Netlify Forms. Your use of the Site is also subject to Netlify's own terms and policies, which we do not control.

9. Governing Law

These Terms are governed by the laws of the State of New Jersey, USA, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Site shall be subject to the jurisdiction of the courts located in New Jersey.

This Section 9 governs disputes about use of the Site itself. If you engage FORA Digital LLC for services under a signed Website Design and Development Services Agreement, that Agreement's own dispute resolution terms (including good-faith negotiation and binding arbitration) will govern any dispute arising from that engagement instead.

10. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with a revised effective date. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
